Definitions
These "terms of use" are an agreement between the owner of "theatremusic.org" and of the copyright of the works published on that site, hereafter also referred to as "us" and "we", and the visitor/user of "theatremusic.org" and/or the performer(s)/user(s) of any (part) of the works published and offered for downloading on this site, hereafter referred to as "you".

Applicability
By visiting this website and/or viewing and/or using (any of) its content you agree to be bound by these terms. If you do not agree to these terms, you should cease using this website. As it might be necessary for us to change these terms from time to time, you should check these terms regularly. Your continued use of "theatremusic.org" will be deemed acceptance of the updated or amended terms. If you do not agree to the changes, you should cease using this website. This site or any portion of this site may not be reproduced, duplicated, copied, sold, resold or otherwise exploited for any purpose, commercial or otherwise, that is not expressly permitted by these terms, or without prior and written permission of the owner of this site.

Intellectual property
All copyright in and on "theatremusic.org" and all content located on this site shall remain vested in the owner of this site, except where credited otherwise. You may not copy, reproduce, republish, perform, change, download, post broadcast, make available to the public, or otherwise use the content in any way except as expressly permitted by these terms. Any other use of "theatremusic.org" content requires our prior and written permission.
All the works published on this site are and remain the intellectual property of their author/composer. These property rights are in no way forfeited, and these works are not given free into the public domain.

Permission
The works that can be downloaded from “theatremusic.org” are being offered for royalty-free use in live performances or recordings exclusively under the conditions as specified hereafter. The owner of the copyright may revoke this permission at any time, and you shall immediately stop your activities related to this permission upon notice.
  • These works, or part of these works may in no way be used for commercial purposes or financial gain.
  • These works must be performed or recorded in accordance with and using the on "theatremusic.org" offered scripts, sheet music and (if applicable) backing tracks, without alterations, cuttings, adaptations, additions or other changes in text or music, except for those for which prior and written consent is given by the author/composer.
  • These works may in their entirety be performed in public exclusively by non-professional drama groups, working on a non-profit base. "Professional" is defined as receiving payment in any way in compensation for (contributing to) a performance. The number of performances of one and the same work will be limited to no more than six in a period of one year, as from the date of the first performance.
  • Parts of these works (unedited excerpts, e.g. separate scenes, songs, etc.) may be performed in public by non-professional drama groups working on a non-profit base, or by individual artists, (semi-)professional or amateur. The number of performances of one and the same (part of a) work are limited to no more than ten in a period of one year, as from the date of the first performance.
  • No part of any of these works (e.g. separate songs, scenes, etc.) may be used to assemble, add to, or complement other works, new or existing, or be presented as being part of another work, or used or presented in any other way not intended by the author/composer.
  • Audio and/or video recordings may be made of any performance, and may be published in the world wide web exclusively, but such only on the condition that the recording is first submitted to, accepted by, and published on "theatremusic.org", and that the author/composer is properly and distinctly credited.
  • The name of the author/composer as it appears on the sheet music and scripts shall not be removed or made illegible in any other way.
  • The author/composer will be properly and distinctly credited in all programs distributed in connection with performances of the works and in all instances in which the title of a work appears for purposes of advertising, publicising or otherwise exploiting the work and/or a production. The name of the author/composer must also appear on a separate line, on which no other name appears, immediately following the title, and must appear in size of type not less than fifty percent the size of the title type. A performance of any excerpts from a work, complete scenes, songs or approved cuttings, must be billed and credited as "scene (number/act nr.) or song (title) from (title) by (author/composer)".
    From the above conditions can only be departed with prior and written consent of the owner of copyright.

    Contributions
    By submitting any contribution (including any text, photographs, graphics, video or audio) to "theatremusic.org", you agree to grant us, free of charge, permission to use the material in any way we want (including modifying and adapting it for operational and editorial reasons). Your contribution will exclusively be used for the promotion of the works published on this website, and will not be used for any commercial purpose. Copyright in your contribution will remain with you and this permission is not exclusive, so you can continue to use the material. By submitting a contribution you affirm that it is your own original work, does not infringe any Dutch or local laws, that you have the right to give us permission to use it for the purposes specified above, and that you have the consent of anyone who is identifiable in your contribution or the consent of their parent/guardian if they are under age. We may refuse any contribution on account of it's content, relevance or recording quality.

    Liability
    In no event will "theatremusic.org" be liable for damages of any kind, directly of indirectly arising out of or in connection with the use of "theatremusic.org", such as, but not limited to, those resulting from loss of profit, contracts, goodwill, data, information, income, anticipated savings or business relationships, whether or not such damage was foreseen or forseeable.
    We do not warrant that "theatremusic.org" is error free, that defects will be corrected, or that "theatremusic.org" or the server that makes it available are free of viruses or bugs. You acknowledge that it is your responsability to implement sufficient measures to protect your system and your data against such threats. We recommend that you scan every file before downloading.

    Links to other sites
    "theatremusic.org" includes hyperlinks to sites maintained or controlled by others. We are unable to provide any warranty regarding the accuracy or completeness of the context of such sites, or the reliability, quality or effectiveness of any products provided through such sites. A link to an external site does not imply an endorsement of the views, information or products provided or held by such sites.

    General
    If any of these terms are conflicting with or vitiated by information given on other pages of "theatremusic.org", these terms shall have precedence and shall be decisive in any dispute that might arise from such a conflict.
    If any of these terms are determined to be illegal, invalid or otherwise unenforceable by reason of the laws of any state or country in which these terms are intended to be effective,  then to the extent and within the jurisdiction in which that term is illegal, invalid or unenforceable, it shall be severed and deleted from these terms and the remaining terms shall survive and continue to be binding and enforceable.
    The failure or delay of us to exercise or enforce any right we can derive from these terms or can exercise in consequence of these terms, does not waive our right to enforce that right.
    These terms shall be governed by and interpreted in accordance with the laws of the Netherlands which shall have exclusive jurisdiction over any disputes.
